• "saau-yuen" / "we" / "us" — the senior living residence operated at 19 Cumberland Road, Kowloon Tong, Kowloon, Hong Kong.
• "Website" — the website accessible at saau-yuen.pro and its associated pages.
• "User" / "you" — any individual who accesses the website or contacts saau-yuen.
• "Services" — the lifestyle and residential arrangements described on this website, including Daily Living Support, Excursions and Day Outings, and Complete Residence Living.
• "Agreement" — these Terms and Conditions together with any service arrangement entered into between you and saau-yuen.

2. Acceptance of Terms

By using this website or engaging saau-yuen's services, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. If you are acting on behalf of another person (such as an older relative), you confirm that you have the authority to do so.

3. Service Description

saau-yuen provides non-medical lifestyle support and residential arrangements for older adults in Hong Kong. Services are described in detail on the Solutions page of this website. We are a lifestyle community and do not provide clinical, nursing or medical care. Residents seeking medical attention continue to engage their own healthcare providers independently.

Services are provided within our Kowloon Tong premises and, in the case of outings, in locations across Hong Kong. Availability is subject to capacity and may vary.

4. User Responsibilities

Users of this website agree to use it only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:

• Submit false, misleading or fraudulent information through any form on this website
• Attempt to gain unauthorised access to any part of the website or its systems
• Use the website in any manner that could damage, disable or impair it
• Reproduce, distribute or commercially exploit website content without our prior written consent

5. Intellectual Property

6. Payment Terms

Services are billed monthly in Hong Kong dollars (HKD). Pricing is as set out in our service descriptions and agreed upon at the time of arrangement. Invoices are issued at the start of each calendar month. Payment is due within 14 days of the invoice date unless otherwise agreed in writing.

Pricing may be reviewed with reasonable notice. Any changes will be communicated in writing at least 30 days before they take effect.

7. Service Arrangements and Termination

Service arrangements may be modified, upgraded or discontinued by either party with 30 days' written notice unless circumstances require shorter notice. saau-yuen reserves the right to terminate or suspend a service arrangement where a resident's needs have changed beyond what we can safely or appropriately accommodate.

On termination of a Complete Residence Living arrangement, the resident or their representative is responsible for collecting personal belongings within 14 days. Any amounts owed to either party shall be settled within 30 days of termination.

9. Limitation of Liability

To the extent permitted by Hong Kong law, saau-yuen's liability in connection with these terms, the website or any service is limited to the amount paid by the user in the calendar month in which the relevant issue arose. We shall not be liable for indirect, consequential, incidental or special damages. Nothing in these terms limits liability for death, personal injury or fraud caused by our negligence.

10. Indemnification

You agree to indemnify and hold saau-yuen harmless from any claims, losses, damages or expenses (including reasonable legal fees) arising from your breach of these terms or your misuse of this website.

11. Governing Law and Dispute Resolution

These terms are governed by the laws of Hong Kong Special Administrative Region. Any dispute arising from these terms or the use of our services shall first be subject to good-faith negotiation. If unresolved, disputes shall be referred to the courts of Hong Kong, which shall have exclusive jurisdiction.

12. General Provisions

• Entire Agreement: These terms, together with any signed service agreement, constitute the entire agreement between the parties with respect to the subject matter herein.
• Severability: If any provision of these terms is found invalid or unenforceable, the remaining provisions shall continue in full force.
• Waiver: Failure to enforce any provision shall not constitute a waiver of the right to enforce it in future.
• Assignment: You may not assign any rights or obligations under these terms without our prior written consent.
